B. You also understand and agree that the Gritwire Website may include advertisements and that these advertisements are necessary for Dizpersion to provide the Gritwire Website.

C. Unless explicitly stated otherwise, any new features that augment or enhance the current Gritwire Website shall be subject to the TOS.

D. You understand and agree that the Gritwire Website is provided "AS-IS" by Dizpersion and that Dizpersion assumes no responsibility for the timeliness, deletion, mis-delivery or failure to store any user communications or personalization settings.

5. Use the communication tools of the Gritwire Website ( e.g., e-mail, messaging, blogging and the like) to send unsolicited bulk communications, to authorize others to use your account or sub-accounts to send unsolicited bulk communications, to cause unsolicited bulk communications to be sent by someone else, and to harvest or collect information about users of the Gritwire Website and use that information for the purpose of sending unsolicited bulk communications.

B. You agree that Dizpersion may take any legal remedy and any technical remedy deemed necessary by Dizpersion to prevent or cure any member misconduct by you under this section V.

C. You agree that any violation of this Section V by you may result in immediate termination of your member account and legal action against you by Dizpersion.

A. Dizpersion does not control the Content posted via the Gritwire Website and, as such, does not guarantee the accuracy, integrity or quality of such Content. You understand that by using the Gritwire Website, you may be exposed to Content that is offensive, indecent or objectionable.

B. Under no circumstances will Dizpersion be liable in any way for any Content, including, but not limited to, for any errors or omissions in any Content, or for any loss or damage of any kind incurred as a result of the use of any Content posted, emailed, transmitted or otherwise made available via the Gritwire Website.

D. Without limiting the foregoing, Dizpersion and its designees shall have the right to remove any Content that violates the TOS or is otherwise objectionable.

D. No Right of Survivorship and Non-Transferability. You agree that your Dizpersion account is non-transferable and any rights to your member account of the Gritwire Website or contents within your account terminate upon your death. Upon receipt of a copy of a death certificate, your member account may be terminated and all contents therein permanently deleted.

E. Statute of Limitations. You agree that regardless of any statute or law to the contrary, any claim or cause of action arising out of or related to use of the Service or this Agreement must be filed within one (1) year after such claim or cause of action arose or be forever barred.

F. Member Disputes. You are solely responsible for your interactions with other members of the Gritwire Website, and Dizpersion reserves the right, but has no obligation, to monitor disputes between you and other members of the Gritwire Website
